Child Custody
Issues of child custody changed drastically in October 2008 when new laws became effective abolishing the terms child custody, primary residential parent and secondary residential parent. The law now does not designate a primary or secondary parent but, rather, sets a timesharing schedule for the child. The courts also must now implement a detailed parenting plan addressing all issues related to the children including extra-curricular, decision making power regarding medical and educational decisions, and much more. As a result of the changes in the law, many courts now start from the premise that the parties should share 50/50 timesharing so long as the parties live in the same school district. Child Custody, therefore, has become much more detailed and complicated and the assistance of an attorney is needed to navigate through the process.
