Paternity
Paternity Actions are filed to determine issues with regard to children between parties who have never been married. In Paternity Actions, the Courts determine whether the Father is the biological parent, visitation and child support. A paternity addresses the same issues with regard to children as a divorce with no property settlement issues. Unlike a Divorce, the Court in a Paternity Action determines whether the father is the biological father. A child born between married parents is presumed the biological child of the Husband. However, even if the Father acknowledges he is the Father, a Paternity action may still be filed to determine visitation, child support and other issues relating to the child.
