Divorce Modifications, also called post-judgment matter may attempt to almost change any provision in a final order of divorce but are commonly used to change custody, child support, alimony or visitation. There are very specific legal standards which apply and the client must trust the attorney to give an honest evaluation of the client’s chances of success in the modification. A Modification proceeds much like a divorce in that the other party must be formally served and answer, the parties must engage in discovery and attend mediation prior to trial.Therefore, a modification may be a complicated process and should not be endeavored lightly.
